How the Pre-1994 Fixture Law Works
California's water-conserving fixture law applies to residential properties built on or before January 1, 1994. It is triggered when you sell the home or remodel with a permit. At that point, any noncompliant plumbing fixtures must be replaced with water-conserving ones, and sellers must disclose any remaining noncompliant fixtures. The four fixture types covered are toilets, urinals, showerheads, and interior faucets — each with a maximum flow or flush volume. If you are preparing a Sonoma or Marin County home for sale, Dusty can identify which fixtures are noncompliant and replace them with water-conserving equivalents. See our California Plumbing Rules page for the full reference.
Fixture Checker FAQ
What is the pre-1994 water-conserving fixture law?
Under California Civil Code Sections 1101.1 to 1101.8, homes built on or before January 1, 1994 must have noncompliant plumbing fixtures replaced with water-conserving ones, and sellers must disclose noncompliant fixtures. The law is triggered by a sale or a remodel with a permit.
What counts as a noncompliant plumbing fixture?
A fixture is noncompliant if it is a toilet using more than 1.6 gallons per flush, a urinal using more than 1 gallon per flush, a showerhead flowing more than 2.5 gallons per minute, or an interior faucet flowing more than 2.2 gallons per minute.
Do I have to replace fixtures if I am not selling or remodeling?
The disclosure and replacement requirements are triggered by a sale or a remodel with a permit. You can still choose to upgrade older fixtures at any time to save water and improve performance. Dusty can help with that.
How do I know which of my fixtures are noncompliant?
A plumber can check the flow rates and flush volumes of your fixtures, or you can ask your real estate agent or local building department. Dusty identifies noncompliant fixtures and replaces them with water-conserving equivalents.
